DEFAMATION PROCEEDINGS
Seven Network
In October 2011 Haldeman LLC filed defamation proceedings in the Supreme Court of Western Australia against Seven Network, operators of Channel 7, for untrue statements broadcast on the Sunrise program on 15 September 2011 and published on the Yahoo7! website. A copy of the writ of summons issued on 5 October 2011 is available here. This summons ordered Channel 7 to appear to court to defend the defamation action taken by Haldeman LLC. Haldeman LLC and Seven Network have since reached a confidential out of court settlement and this matter is now finalised.
TVWorks Ltd
The proprietor of Haldeman LLC has also filed defamation proceedings in the Auckland High Court on March 31st, 2011 against TVWorks Ltd, operators of TV3 in New Zealand. In case number CIV-2011-442-116 there are several causes of action details, relating to seriously defamatory material broadcast on the Campbell Live program and published on the TV3 website. TVWorks has subsequently removed the defamatory material from their website
The Broadcasting Standards Authority in New Zealand ruled in decision number 2010-064 that TV3 had breached Standard 6 of the Free-to-Air Television Code of Broadcasting Practice and added that, “TVWorks appears to have no evidence” to support the allegations made.
Julia MolesworthOn 15 November 2011 in case number CIV2011-463-748 the proprietor of Haldeman LLC filed defamation proceedings in the Rotorua High Court against Julia Molesworth. These proceedings relate to several defamatory statements made by Ms Molesworth on the Campbell Live television program on 5 March 2010. The defendant is being sued for damages for injury to reputation, special damages for loss of earnings, exemplary damages of $50,000 and also for costs of the proceedings.
